Terms and Conditions
Use of CMHA of NB’s name is permitted only with CMHA of NB approval;
CMHA of NB must review and approve all promotional materials (including, but not limited to, letters, brochures, press releases, flyers, and advertising) prior to distribution;
All promotional materials must clearly state the percentage of proceeds or portion of ticket price that will be donated to CMHA of NB;
Only the final net proceeds will be processed by CMHA of NB. Under no circumstances will third party revenues and expenses flow through CMHA of NB;
CMHA of NB is not financially liable for the promotion and/or staging of third party fundraisers;
The organizer of the fundraiser that is the subject of this agreement shall indemnify and hold harmless the Canadian Mental Health Association of New Brunswick, its officers, directors, and employees, from and against any and all claims, liabilities, costs, fines and expenses (including reasonable legal fees) arising out of any claims or suits, or threats of suits, which may be brought against CMHA of NB for any reason whatsoever in connection with the fundraiser, including, but not limited to, claims related to personal injury related to the fundraiser. The organizers’ obligations hereunder shall survive the termination of this agreement.
CMHA of NB does not permit the following types of fundraising in a third party context:
- Programs that raise money on commission;
- Events that encourage/involve behaviour that is counter to the CMHA of NB mission and/or programmatic activities;
- Events involving promotion or support of a political party or candidate, or those which appear to endorse a political activity;
- Direct solicitation (including, but not limited to, door-to-door canvassing, telemarketing or internet).
CMHA of NB reserves the right to withdraw the use of its name at any time.
If the fundraiser is cancelled or rescheduled, the organizer will notify CMHA of NB as soon as possible. If it is an event, notification will be least 24 hours prior to the original date of the event.
CMHA of NB will provide limited technical support, but event organizers are expected to administer their own online event page (e.g., post information, send email requests).
I give permission to CMHA of NB to use the photographs and content, as submitted by me, in CMHA of NB’s online and offline materials.
Guidelines for Sponsorship
The CMHA of NB appreciates the support of the groups and business in our community who sponsor events to raise funds for CMHA of NB.
In approving sponsored events the following guidelines shall be considered:
- A) Sponsor’s Community Profile:
This should not, by association, have the potential to adversely affect CMHA of NB’s image. - B) Sponsor’s Business Mission:
This does not conflict with CMHA of NB’s mission and goals which promote a healthy community. - C) Nature & Activities of Event:
These activities will not be in-congruent with what the public would perceive CMHA of NB to be. - D) Success:
The event being considered should have a reasonable chance for success. - E) Long Term Plans:
The event does not compromise or have the potential to adversely affect CMHA of NB’s annual or long range plan for fundraising and development. - F) Permits:
The sponsor will obtain at their own expense all permits and licenses required by any competent government authority. - G) Assignment:
The sponsor has no right whatsoever to assign this “Special Event Permit” to any other party. - H) Liability:
The sponsor shall indemnify and hold CMHA of NB from and against all liability, claims, damages, or expenses due to or arising out of the proposed “Special Event”.
